Not discriminatory at all.

I'll take any Supreme Court judge as long as they aren't black. Could you imagine if Obama said something like that? Or if the US Congress said something like that? Pretty sure that would be a ACLU nightmare led by the league leader, Rev. Sharpton. But for some reason, when Congress and the President dictate (without saying it verbally) that the next Supreme Court nominee can NOT be a white man, nobody has a problem with it. Is there still that much guilt in this society? Apparently the best person for the job doesn't matter, but color and sex do.

The Supreme Courts job is to enforce the rule of law, not to create or model it. When Obama says things like wanting judges to understand the plaintiff or defendants' 'life' that is a huge problem. The Supreme Courts role, and the judiciary as a whole, is not to create the rules and watch individual circumstance but to apply the rules fairly and blindly across the board regardless of color, situation or upbringing. It is the legislative bodies job to create the rules that model after the above conditions.

For someone who 'studied the Constitution' and 'graduated from Harvard' he sure is lacking.
